Impeachment of George W. Bush for War in Iraq and Torture Policy

  "The implementation of Project for the New American Century (PNAC), starting with invading Iraq was a flagrant, reckless, arrogant, and dangerous violation of U.S. and international law. Although some of the most powerful in the world put their hand to a  written plan for global domination and are openly executing it, our Congress, our democracy, sits on the sidelines and does nothing, as though they are spectators at a sporting event. Political intimidation has frozen the processes of law and there is no accountability for those who are above the law."  

The Opportunity Needed - A New "Pearl Harbor"

George W. Bush plotted with others starting as early as 1998 to go to war with Iraq as part of a strategy to dominant the Middle East and its oil, to dominant cyberspace, to dominant space and to keep the United States as the world's sole superpower by repressing all challengers by any means necessary including illegal and unlawful actions and false and misleading statements. Knowing their mission, George W. Bush joined with Dick Cheney, Donald Rumsfeld, Paul Wolfowitz, I Lewis Libby, John Bolton, Jeb Bush, Elliot Abrams and others made a written plan to deliberately, willfully, wantonly and recklessly violate United States statutory law and international law by promoting, causing, commencing and justifying  a war on Iraq that he and all involved knew was clearly illegal.

The actions of the President and these men was, and now is, an abuse of authority inconsistent with the President's constitutional duty to faithfully execute the laws and constitute high crimes and misdemeanors and reckless disregard for the truth and the law. In his conduct of the office of President of the United States, George W. Bush, and others violated the constitutional oath to faithfully execute the office of President and to preserve, protect, and defend the Constitution of the United States, and violated the constitutional duty to take care that the laws be faithfully executed. In so doing George W. Bush has contributed to world instability, greatly increase hatred and distrust for America around the world, placed himself and the United States above the law, made America a flawed example of democracy, has destroyed or is destroying the principles for which America stands and has and is endangering the the safety and security of America for personal ambitions.

President George W. Bush Committed Acts that Constitute Grounds for an Impeachment


           WE THE UNDERSIGNED HEREBY submit that there is substantial and credible evidence that President George W. Bush deliberately and consciously conspired to commit high crimes or misdemeanors while acting as the President of the United States and submit that there is substantial and credible evidence that the President's actions with respect to the war in Iraq and related actions in the “war on terror” constitute an abuse of authority inconsistent with the President's constitutional duty to faithfully execute the laws. In his conduct of the office of President of the United States, George W. Bush, violated his constitutional oath to faithfully execute the office of President to the best of his ability and to preserve, protect, and defend the Constitution of the United States, and violated his constitutional duty to take care that the laws be faithfully executed.

Starting September 11, 2000, and for sometime prior thereto, George W. Bush and members of his administration commenced a plan, scheme and design to start an illegal war on Iraq as part of a strategy to dominant the Middle East and the resources thereof. Subsequent thereto, George W. Bush, using the powers of his high office, engaged personally and through his close subordinates and agents, in a course of conduct or plan designed to justify and cause an illegal war with Iraq and commit war crimes in furtherance of the plan with full knowledge that his actions were not permitted by United States or international law. 

WHEREAS, President Bush consciously and deliberately conspired to exceed his constitutional authority to wage war, to ignore the supreme law of the land and the rule of law and in furtherance of such plan:

1.   consciously, deliberately and with premeditation violated the House Joint Resolution Authorizing Use of Force Against Iraq, October 10, 2002, which was made specifically subject to the War Powers Resolution of 1973, by planning and waging  aggressive wars and by going to war in Iraq without evidence, finding or reasonable basis for believing that there was clear evidence that  Iraq was an imminent threat to the United States; that there was a national emergency caused by Iraq; or that there were hostilities with or within Iraq sufficient to justify war;
 

2.   consciously, deliberately and with premeditation conducted a propaganda campaign to falsely convince the American public that there was clear evidence that Iraq posed an imminent threat to the United States and that war on Iraq was necessary to preemptive self-defense of the United States knowing that the impressions being created were false and misleading and without adequate basis in fact or in law;
 

3.   consciously, deliberately and with premeditation caused, condoned or ratified the presentation of false and misleading evidence to the United Nation Security Council;
 

4.   consciously, deliberately and with premeditation concealed evidence and ignored reports that would have shown that the evidence presented to the United Nations was false, misleading and subject to interpretations other than for the purpose presented;

5.   making false or misleading statements to the press and members of Congress about the certainty that Iraq had weapons WMD;

6.   withholding relevant and material evidence or information about the certainty that Iraq had weapons WMD;

7.   approving, condoning, acquiescing in, and counseling members of the administration with respect to the giving of false or misleading statements to the press and members of Congress about the certainty that Iraq had weapons WMD;

8.   interfering or endeavoring to interfere with the conduct of investigations by the 9/11 Commission and Congressional Committees;

9.   making or causing to be made false or misleading public statements for the purpose of deceiving the people of the United States into believing that Iraq posed an imminent threat to the United States.

10.  consciously, deliberately and with premeditation has operated the Office of President with great secrecy, exerting executive privilege, denying the truth, and attacking the credibility and patriotism of opponents to war in Iraq in order to conceal an illegal an unlawful plan to dominant the Middle East and the resources thereof;  

WHEREAS, President Bush consciously and deliberately conspired to violate international law, Article VI Clause 2 of the United States Constitution and treaties under authority of the United States and in furtherance of such plan violated Chapter 1, Article 2 of the United Nations Charter and Principal VI of the Nuremberg Charter without evidence, finding or reasonable basis for believing that the standards set forth therein had been met and knowing that all treaties made, under the Authority of the United States, shall be the supreme Law of the Land. 

WHEREAS, George W. Bush and others conspired to illegally and unlawfully unilaterally enforced Security Council Resolution 1441, by trick, device and deception upon the United Nations Security Council by making deceitful representations to the United Nations Security Council that there would be a second United Nations Security Council resolution before any use of force would be employed upon Iraq knowing that there was no intent to get a second resolution from the United Nations Security Council and that the United States would use Resolution 1441 as an ostensible basis for an illegal war and falsely claim that the United Nations Security Council had seen the evidence and approved the war.

WHEREAS, President Bush failed to take care that the laws were faithfully executed by failing to act when he knew or had reason to know that prisoners were being tortured at Abu Ghraid and elsewhere in violation of United States law and international treaty.

1.   starting as early as January 2002, George Bush was personally involved in establishing a White House policy on torture that encouraged torture, by creating technical ostensible defenses to torture, creating "rights free zones," by permitting other countries to do the torture for the United States, by focusing on defining the outer limits of lawful torture and by disseminating instructions to the U.S. military making the standards for torture by U.S. soldiers so liberal that anything short of a "good faith" intent to kill or "good faith" intent to permanently maim was acceptable.

 

2.   condoning, ratifying and otherwise approving of inhumane treatment of prisoners and torture as evidence by Bush personally receiving a memo in January of 2002 that specifically advised him that "torture" was occurring at Abu Ghraid prison and by not acting on this information until after the story broke on CBS's 60 Minutes and in News Week and  the New Yorker in May - four months after Bush was informed of the "torture;"

 

3.   All of the forgoing was condoned, ratified and otherwise approved by George W. Bush in direct violation of the Anti-torture Law of 1994; United Nations Convention Against Torture;  the Universal Declaration of Human Rights states; and The Army Field Manual. 

WHEREAS, in furtherance of the conspiracy to dominant the Middle East and control the resources thereof, George W. Bush and his agents and subordinates are, and have been, conducting a coordinated public relations campaign to convince the American public that Iran poses a threat to the United States and the world because Iran may be attempting to obtain nuclear weapons: floating the idea of strike upon Iran by the United States or Israel: asserting the premise that Iran can not obtain nuclear weapons as a fact which automatically equates to threat to the United States and the world: creating the impression that Iran cannot be trusted; creating the impression that Iran is concealing its nuclear program; attempting to incite internal revolution and resistance to the current Iran government; making implied, if not direct, treats of military action against Iran: and otherwise taking action that will set the stage, create crisis,  and otherwise exacerbate the situation in order to create the conditions for and an ostensible justification for a preemptive military strike upon Iran and/or support for Israel in the event that it strikes first.  

WHEREAS, the actions and conduct of George W. Bush and his agents and subordinates provides credible and convincing evidence that the administration is embarking upon a strategy design to create a war with Iran using the same or similar methods used to create war with Iraq and there is good cause to believe they will pick and choose intelligence to justify there pursuits and rely upon sources for information that are not credible, disseminate false and misleading information, disregard information or warning which do not support their predetermined course, and otherwise act to create and justify a war with Iran knowing that such war will violate United States law, the War Powers Resolution of 1973, and international law.

WHEREAS, in all of this, George W. Bush has acted in a manner contrary to his trust as President and subversive of constitutional government, to the great prejudice of the cause of law and justice and to the manifest injury of the people of the United States.

WHEREFORE George W. Bush, by such conduct, warrants impeachment and trial, and removal from office for his conduct of the war with Iraq, torture practices, and for taking steps in preparation for an illegal war on Iran.
 


Overview
Project for the New American Century

"The Project for the New American Century (of which Dick Cheney is a founding member) seeks to establish what they call 'Pax Americana' across the globe. Essentially, their goal is to transform America, the sole remaining superpower, into a planetary empire by force of arms. A report released by PNAC in September of 2000 entitled 'Rebuilding America's Defenses' codifies this plan, which requires a massive increase in defense spending and the fighting of several major theater wars in order to establish American dominance." (from article entitled "Blood Money" by William Rivers Pitt).

PNAC's vision as detailed in "Rebuilding America's Defenses"
builds upon the 1992 post cold war strategy embodied in a draft document entitled " Defense Planning Guidance." This document was the start of the ideology which became PNAC and became current U.S. policy adopted by Bush. The Defense Guidance Plan sought to maintain the U.S. as the sole superpower by repressing potential challengers to U.S. preeminence through pre-emption rather than containment and unilateral military action rather than multilateral internationalism. It asserted that the U.S. must "discourage advanced industrial nations from challenging our leadership or even aspiring to a larger regional or global role"  

"This draft called for the United States to use its unmatched military power to prohibit any other nation in the world from rivaling the power of the United States, the only remaining superpower after the fall of the Soviet Union, and to safeguard "access to vital raw material, primarily Persian Gulf oil." This recommendation included military intervention in Iraq to safeguard this "raw material." This document was not intended for public view and after it was leaked to the New York Times it caused alarm among U.S. allies and Congress. It was later revised." (See:Bush/Cheney 2004)

The draft was attributed to Dick Cheney and Paul Wolfowitz as the authors.

The PNAC project for global domination is a  movement considered to be lead by neoconservatives.

"As a rule, the term refers more to journalists, pundits, policy analysts, and institutions affiliated with the Project for the New American Century (PNAC) and with Commentary and The Weekly Standard than to more traditional conservative policy think tanks such as the American Enterprise Institute (AEI) and Heritage Foundation or periodicals such as Policy Review or National Review. The neoconservatives, often dubbed the neocons by supporters and critics alike, are credited with or blamed for influencing U.S. foreign policy, especially under the administrations of Ronald Reagan (1981-1989) and George W. Bush (2001-present). Neoconservatives have often been singled out for criticism by opponents of the 2003 invasion of Iraq, many of whom see this invasion as a neoconservative initiative."  (Wikipedia)

Executing the Plan

 

Highlights of the "American grand strategy" and "blueprint of world domination":

PNAC's vision is detailed in its September 2000 report entitled "Rebuilding America's Defenses: Strategy, Forces and Resources for a New Century." (RAD). The RAD document - which evolved from the Defense Planning Guidance document and PNAC which was established in 1998 - plans for the United States to:

  • Withdrawal from international treaties. Withdraw from the Anti-Ballistic Missile Treaty.
  • Stop reducing missiles. Stop the reduction of nuclear missiles
  • Nuclear arms race. Develop "new" nuclear weapons
  • Missile defense. Deploy a national missile defense system
  • Increase military spending. Increase defense spending to a minimum 3.8 percent of gross domestic product
  • Multiple, simultaneous major theatre wars. "Fight and decisively win multiple, simultaneous major theatre wars" as a "core mission." And, "retain sufficient forces able to rapidly deploy and win multiple simultaneous large-scale wars and also to be able to respond to unanticipated contingencies in regions where it does not maintain forward-based forces."
  • Control Gulf. Take military control of the Gulf region whether or not Saddam Hussein is in power.
  • Create justification. Use Iraq as the "immediate justification" for greater goals that "transcends" Iraq stating: "While the unresolved conflict with Iraq provides the immediate justification, the need for a substantial American force presence in the Gulf transcends the issue of the regime of Saddam Hussein."
  • Pressure China. Increase military pressure on China.
  • Expand military parameters. Use Iraq to expand military parameters to protect Taiwan.
  • Create military presence in Southeast Asia. Asserts "it is time to increase the presence of American forces in southeast Asia" which will lead to "American and allied power providing the spur to the process of democratization in China"
  • Remove hostile regimes. Warns that "we cannot allow North Korea, Iran, Iraq or similar states to undermine American leadership," and American military preeminence rests on the ability to "[remove] a dangerous and hostile regime when necessary."
  • Command and control. Develop a "world-wide command-and-control system" to contain dangerous regimes of North Korea, Libya, Syria, and Iran.
  • Circumvent U.N. Authority. Keep all peacekeeping and rebuilding missions within the power of American political leadership rather than that of the United Nations.
  • Use key allies. Use key allies, such as the U.K., as the "most effective and efficient means of exercising American global leadership."
  • Permanent bases in Middle East. Take military control of the Persian Gulf region through the establishment of permanent bases. "The Air Force presence in the Gulf region is a vital one for US military strategy, and the United States should consider it a de facto permanent presence, even as it seeks ways to lessen Saudi, Kuwaiti and regional concerns about US presence" (p. 35).
  • Dominant space. "creat[e] ...'US Space Forces', to dominate space."
  • Dominate cyberspace. Take total control of cyberspace to prevent 'enemies' using the internet against the US," otherwise, "[America] will find it difficult to exert global political leadership."
  • The new American frontier. Characterizes the U.S. forces are "the cavalry on the new American frontier"

PNAC expressed concerned about a more rapid implementation of its aggressive defense policy noting the transformation would come about slowly, unless there were "some catastrophic and catalyzing event, like a new Pearl Harbor."
 

Conclusion

The implementation of Project for the New American Century (PNAC), starting with invading Iraq and the condoning of torture was a flagrant, reckless, arrogant, and dangerous violation of U.S. and international law. Although some of the most powerful in the world put their hand to a  written plan for global domination and are openly executing it, our Congress, our democracy, sits on the sidelines and does nothing, as though they are spectators at a sporting event. Political intimidation has frozen the processes of law and there is no accountability for those who are above the law for they make their own.
